By consenting to the terms in this agreement, I hereby acknowledge that I voluntarily wish to participate in an activity for which I am registering (the “Event”).
This Agreement is intended to be as broad and inclusive as permitted by law. If any provision or any part of any provision of this Agreement is held to be invalid or legally unenforceable for any reason, the remainder of this Agreement shall not be affected thereby and shall remain valid and fully enforceable.
I accept and assume all risks arising from my participation in the Event, and agree to waive, discharge claims, release from liability, covenant not to sue and hold harmless the Association for Creatine Deficiencies, Inc. (“ACD”) and its officers, directors, employees or members, any sponsor, organizer, volunteer, volunteer organization, contractor, and subcontractor or administrator of ACD events or of any of the foregoing (collectively, the “ACD Releasees”) from any and all liability on account of, or in any way resulting from personal injury, property loss or damage or death, even if caused by negligence of the ACD and/or the ACD Releasees, in any way connected with the Event. I further agree to hold harmless the ACD Releasees from any claims, damages, injuries or losses caused by my own negligence while a participant in the Event. I understand and intend that this assumption of risk and release is binding upon my heirs, executors, administrators and assigns, and includes any minors accompanying me in the Event.
I understand that in all cases, my registration fee is non-refundable. The ACD will not issue refunds for registration fees for any reason, including cancellation due to threat of or acts of God, war, terrorism, disaster, earthquake, government regulation, and/or for economic/financial reasons.
I hereby consent to the use by ACD and its permitees of my name, photograph, and likeness in connection with my participation in the Event and related activities.
I agree that all disputes and matters concerning this waiver, its interpretation, performance or breach, shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principals, and shall be litigated in and before the state or United States District Court located in the City of San Diego, California. to the exclusion of the courts of any other State or Country.
I have read this agreement in its entirety, I understand its terms, and I agree to be bound by its terms. I further agree that I have signed this acknowledgement voluntarily and no oral representation, statements or inducements apart from the foregoing written agreement have been made.
